These Terms and Conditions (“Terms”) govern your use of the mobile applications developed by SgtWarfare LLC (“Company,” “we,” “us,” or “our”): Franco Food, Franco Drive, and Franco Business (collectively, “Franco Apps”). By downloading, installing, or using any of the Franco Apps, you agree to be bound by these Terms. If you do not agree, you must not use our services.
1. Eligibility
You must be at least 18 years old to use any of the Franco Apps.
By creating an account, you represent that all information provided is true, accurate, and complete.
We reserve the right to refuse service or terminate accounts if eligibility requirements are not met.
2. Accounts and Registration
You must register an account to access core features.
You are responsible for maintaining the confidentiality of your account and password.
You agree not to share, rent, or sell your account credentials.
You are responsible for all activities that occur under your account.
3. Services Overview
Franco Food (Customers)
Enables users to order food, groceries, clothing, tools, and other products from local and international vendors.
Payments may be made via cash or card.
Orders may be canceled according to business and app policies.
Franco Drive (Drivers)
Allows individuals to deliver orders and earn income.
Drivers are independent contractors, not employees of SgtWarfare LLC.
Drivers are responsible for compliance with traffic laws and local regulations.
Account sharing, renting, or fraudulent activities are strictly prohibited.
Franco Business (Vendors)
Enables businesses to sell products and services through the Franco ecosystem.
Businesses are responsible for ensuring that product catalogs, menus, pricing, and operating hours are accurate.
Businesses must fulfill orders honestly and on time.
4. User Obligations
All users agree to:
Use the Franco Apps lawfully and respectfully.
Provide accurate and updated information.
Not misuse or attempt to manipulate the apps (e.g., fraudulent orders, false claims, or system abuse).
Comply with all applicable laws and regulations.
5. Payments and Fees
Customers agree to pay all applicable charges for orders placed through Franco Food.
Drivers will receive payment for completed deliveries, minus service fees where applicable.
Businesses agree to pay applicable commission or service fees as outlined in their agreement.
Payment disputes must be reported within 7 days of the transaction.
6. Cancellations and Refunds
Customers may cancel orders before businesses begin preparation, subject to vendor policies.
Refunds are issued only in cases of order errors, unavailable items, or non-delivery confirmed by our support team.
Drivers will not be compensated for canceled trips before pickup.
7. Prohibited Conduct
Users must not:
Use the apps for illegal, harmful, or fraudulent purposes.
Harass, abuse, or harm other users, businesses, or drivers.
Attempt to reverse-engineer, hack, or disrupt app functionality.
Share false, misleading, or harmful content.
8. Intellectual Property
All content, trademarks, and designs within the Franco Apps are owned by SgtWarfare LLC.
Users are granted a limited, non-exclusive, non-transferable license to use the apps for their intended purpose.
Unauthorized reproduction or distribution is strictly prohibited.
9. Limitation of Liability
We are not responsible for errors in orders, delivery delays, or business operations.
Franco Drive drivers are independent contractors; we are not liable for their actions, negligence, or misconduct.
We are not responsible for losses caused by inaccurate user information (e.g., wrong delivery address).
To the maximum extent permitted by law, SgtWarfare LLC shall not be liable for indirect, incidental, or consequential damages.
10. Indemnification
You agree to indemnify and hold harmless SgtWarfare LLC, its affiliates, employees, and partners from any claims, damages, losses, liabilities, and expenses arising from your use of the Franco Apps or violation of these Terms.
11. Termination
We may suspend or terminate your account immediately if you:
Violate these Terms.
Engage in fraudulent, harmful, or unlawful activity.
Misuse or attempt to manipulate the apps.
Termination may result in loss of access to your account, pending balances, or earned income (in case of fraudulent activity).
12. App-Specific Rules
Franco Food
Users must ensure delivery details are accurate.
Refunds are processed according to the policy above.
Customers must treat businesses and drivers respectfully.
Franco Drive
Drivers must maintain a valid driver’s license, insurance, and vehicle registration (where applicable).
Drivers must not share, rent, or sell their accounts.
Earnings are processed through secure payment systems.
Drivers are responsible for their own tax obligations.
Franco Business
Businesses must provide accurate catalogs, prices, and availability.
Businesses must not sell illegal, counterfeit, or prohibited products.
Repeated cancellations or unfulfilled orders may lead to account suspension.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Kentucky, United States, without regard to conflict of law principles.
14. Dispute Resolution
Disputes must first be submitted in writing to our support team.
If unresolved, disputes shall be settled through binding arbitration in Louisville, Kentucky, USA.
Class actions and jury trials are waived to the fullest extent permitted by law.
15. Modifications
We may update or modify these Terms at any time. Updates will be published within the apps and on our website. Continued use of the Franco Apps constitutes acceptance of the updated Terms.
