GENERAL TERMS AND CONDITIONS – REMITLY PAYMENTS

These General Terms and Conditions govern the use of Remitly as a payment method within Franco App, and form an integral and inseparable part of the General Terms and Conditions of Franco App. By using Remitly, the user expressly agrees to be bound by these terms.
1. Definitions
Franco App: A technology platform providing digital services including delivery, transportation, business payments, and related services.
User: Any individual or business entity using Franco App.
Franco Business: Business-facing services offered through Franco App.
Franco Drive: Driver and courier services offered through Franco App.
Remitly: Third-party international payment and money transfer service provider.
Transaction: Any payment or transfer initiated through Remitly via Franco App.
2. Scope of Use
2.1. Remitly payments are enabled exclusively for Franco Business and Franco Drive services.
2.2. Remitly is available only for countries outside the United States of America, including but not limited to Guyana, Trinidad and Tobago, Dominica, Gambia, Senegal, and any additional countries that may be enabled in the future.
2.3. Remitly shall be used solely in jurisdictions where Stripe or other card payment processors are unavailable or non-operational.
2.4. Franco App does not own, operate, or control Remitly and shall not be responsible for any failures, delays, rejections, reversals, or errors attributable to Remitly.
3. Payment Processing
3.1. A payment shall be considered completed only once Franco App receives confirmation from Remitly.
3.2. Franco App reserves the right to suspend or withhold services until payment confirmation is received.
4. Fees and Charges
4.1. Remitly may apply service fees, commissions, exchange rate margins, or other charges at its sole discretion.
4.2. All Remitly fees and charges shall be borne exclusively by the user, whether sender or recipient. Franco App does not assume responsibility for any Remitly-related costs.
4.3. Franco App is not responsible for exchange rate fluctuations or additional charges imposed by Remitly.
5. Cancellations, Refunds, and Errors
5.1. All cancellations and refunds involving Remitly payments are subject to both Franco App and Remitly policies.
5.2. Where approved, refunds will be processed through Remitly when technically possible.
5.3. Franco App does not guarantee refund processing times, as they depend on Remitly and the recipient’s financial institution.
5.4. Franco App shall not be liable for incorrect, failed, or misdirected transfers resulting from inaccurate information provided by the user, including but not limited to bank details, debit card numbers, names, or addresses.
6. Country-Specific Conditions
6.1 Dominica
a) Payments to Dominica are limited to direct bank deposits only.
b) Users must correctly provide a 16-digit debit card number or required banking information to receive funds.
c) If incorrect information is provided and the transfer is completed, Franco App shall bear no liability for erroneous or failed transfers.
6.2 Guyana
a) Payments to Guyana are available exclusively as cash pickup transactions.
b) Cash pickup locations will be assigned based on the address provided within the Franco App, prioritizing the nearest available location.
c) Upon completion of the transfer, Remitly will notify the recipient via SMS or email with the necessary information to collect the funds.
6.3 Other Countries
Conditions applicable to Trinidad and Tobago, Gambia, Senegal, Antigua and Barbuda and any future countries shall depend on Remitly’s availability, regulations, and supported payout methods in each jurisdiction.
7. Legal Compliance
7.1. Users represent and warrant that all funds transferred originate from lawful sources.
7.2. Franco App reserves the right to reject, suspend, or report transactions as required by applicable laws or regulatory authorities.
8. Amendments
Franco App reserves the right to modify these terms at any time. Updates will be published within the Platform and shall become effective upon publication.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which Franco App operates, without prejudice to mandatory consumer protection laws.

By using Remitly within Franco App, the user acknowledges that they have read, understood, and agreed to these Terms and Conditions, which form part of the General Terms and Conditions of Franco App.
